This page tells you the terms and conditions (T&Cs) on which we supply the licensed gambling services (Services) on our website www.SwitchPlayed.com (our site) to you. Please read these T&Cs, privacy policy, terms of use and dispute resolution policy (collectively, the Agreement) carefully before registering on our site. You should understand that you agree to be bound by these T&Cs, together with the documents referred to in it, by registering on this site. If there is any inconsistency between the T&Cs and any documents listed, then the terms of T&Cs shall take precedence.

2.SERVICE AVAILABILITY
2.1.
Our site is only intended for use by people resident in England, Scotland or Wales only. We do not accept use of the Service from individuals outside these countries.
3.YOUR STATUS
By registering with our site, you warrant that:
3.1.1.
You are legally capable of entering into binding contracts;
3.1.2.
You are at least 18 years old;
3.1.3.
You agree to provide accurate registration details and inform us of any changes;
3.1.4.
You agree that the account is personal to you and is non-transferable;
3.1.5.
You are resident in either England, Scotland or Wales; and
3.1.6.
You are accessing our site from either England, Scotland or Wales.
4.YOUR ACCOUNT
You are solely responsible for the security of your account. You must keep your password strictly confidential and you are responsible for any misuse of your password and or account. You should change your password regularly to help prevent misuse. We are entitled to assume that any payment, offer or action made from your account is made by you. If another person gains access to your account, you are solely responsible for their actions and you hereby indemnify us and hold us harmless against all costs, claims, expenses and damages howsoever arising in connection with the use of your account.
5.YOUR CONDUCT
5.1.
During your use of the site and Services you agree to act in good faith at all times. You agree to not engage in any collusive betting activity with other users and to act in accordance with any sporting rules, regulations or code of conduct that may apply to you.
5.2.
You agree not to disguise or hide your IP address at all times during your use of the site and Services.
6.DEPOSITS & WITHDRAWALS
6.1.
To play for money on our site, you must first deposit funds in your account. Money can only be deposited into your account via Moneybookers. To set up a Moneybookers account, please click here.
6.2.
Any deposits you make to us are made to and held in a separate customer account until such time as a bet is made. These funds are held as security to meet payment of any obligations you may incur as a result of betting on match events.
6.3.
You confirm and agree that:
6.3.1.
any money deposited in your account does not originate from an illegal activity or source;
6.3.2.
all deposits into your account are authorised and you will not attempt to reverse a depositing transaction by Moneybookers; and
6.3.3.
you are only allowed to make one deposit into the SwitchPlayed account each day.
6.4.
Any withdrawals that you make from your account shall be sent back to the registered Moneybookers account. Any request for a withdrawal shall be processed with 24 hours of request.
6.5.
You agree that no interest shall accrue and be payable to you by us as a result of deposited funds held by us under this Agreement.
7.MONEYBOOKERS
7.1.
Your relationship with Moneybookers is entirely independent and separate from us and by registering an account with Moneybookers you are agreeing to be governed by its own separate terms and conditions.
7.2.
We do not charge any transfer fees to or from Moneybookers accounts, however any charges levied by Moneybookers is entirely your responsibility.
8.BETTING
8.1.
Betting takes place in accordance with the game rules and FAQ section.
8.2.
Bets are accepted by SwitchPlayed upon and at the time of reaching our server(s). Once a bet has been placed, it cannot be withdrawn for any reason, including its placement by your mistake. If a bet is not received by our server(s), then no bet is deemed to have been made. As soon as a bet has been received by SwitchPlayed, you shall receive confirmation of the bet placed together with all relevant details.
8.3.
SwitchPlayed has no control over any network delay and cannot be held responsible for any bets, which are either delayed or fail to reach us at all.
8.4.
Bets are settled automatically and instantly upon the occurrence of a winning condition or event. SwitchPlayed reserve the right to amend a bet or payout should it discover an error.
8.5.
SwitchPlayed reserve the right to withdraw the Service at any time. If the Service is withdrawn, any bets already placed shall be honoured in accordance with the game rules.
9.ERRORS & OMISSIONS
9.1.
You agree to inform us as soon as you become aware of any errors with respect to your account and agree to forfeit any credit balance in your account which occurred by any an act or omission, be it human or technical fault.
9.2.
You agree that in the event of any conflict between data held on your computer and our server(s), the data held on our server(s) shall be considered final and binding.
10.DISPUTE RESOLUTION
10.1.
In the event of any dispute arising between you and us under these T&Cs, we both agree to resolve such dispute in accordance with the Dispute Resolution Policy.
11.SUSPENSION & TERMINATION
11.1.
Either we or you can suspend or terminate your account at anytime by sending notice.
11.2.
During a period of suspension, credit funds can be transferred out of your SwitchPlayed account, unless they are being held in accordance with clause 11.5.
11.3.
Following the termination of your SwitchPlayed account, any credit funds shall be automatically transferred out of the account, subject to clause 11.5.
11.4.
as security by SwitchPlayed for a potential liability which you may have incurred for any reason. Following the final resolution of any potential liability any Following termination of the account,
11.5.
SwitchPlayed will temporarily withhold any credit funds in your account from being transferred that is being held for one of the below reasons:
a)
Is the subject of a dispute with us; or
b)
Is the subject of advice, a request or an instruction from a governmental, regulatory or law enforcement authority.
11.6.
Following SwitchPlayed determining the conclusion of all of the applicable reasons for withholding your credited funds pursuant to clause 11.5, the credit funds shall be returned to you with 24 hours unless it has been determined that these funds shall not be returned to you for any reason.
12.LIMITATION OF LIABILITY
12.1.
You agree that any dispute or claim that you wish to bring shall be brought within 30 days of the event giving rise to that dispute or claim. You hereby agree to waive any right to pursue any claim or potential claim after that period has lapsed.
12.2.
SwitchPlayed is not liable for the interception or misuse of any information which is transmitted and intercepted over the internet.
12.3.
Our maximum liability to you (and any third party) for breach of contract, equitable duty, tort or otherwise shall be limited to the amount you have paid to us under this Agreement.
12.4.
Our maximum liability to you (and any third party) in relation to any bet, shall be limited to the amount you paid to us for that bet under this Agreement.
12.5.
Nothing in this clause 11.6 shall limit SwitchPlayed’s liability for death or personal injury caused by our negligence.
13.MATTERS BEYOND OUR CONTROL
We are not liable for any loss or damage that you may suffer from any matter outside of our reasonable control which affects out ability to perform our obligations under this Agreement.
14.NO WAIVER
No failure or delay by us to exercise our rights under this Agreement shall operate as a waiver and no partial enforcement of our rights shall prevent any other further exercise of that or any other right by us.
15.PRIVACY
15.1.
All information which you send to us through the site shall be processed in accordance with the site Privacy policy.
15.2.
You agree that we may use any means we consider necessary to verify your page, identity and creditworthiness with any third party providers of information.
15.3.
You agree that we can monitor your use of the site and Services including all betting activity.
15.4.
You agree that we can provide your personal details to any governmental regulatory or law enforcement agency if we believe you have acted in breach of this Agreement.
16.COMMUNICATIONS
All notices and other communications sent under these T&Cs should be sent to us by using the site’s online forms where available, or by email to 000 - 028381 - R - 309889 - 001 where no online form exists.
17.UNDERAGE GAMBLING
17.1.
If we know or suspect that you are not of legal age to participate in the Service, we shall immediately suspend your account until an investigation has confirmed whether you are of legal age to participate.
17.2.
If it is determined that you are below the legal age to participate in our Service:
1)
your account shall be terminated;
2)
any account winnings shall be deducted from your account;
3)
you shall be credited with your betting stakes; and
4)
credit funds (if any) shall be returned to you.
18.OTHER BREACHES OF T&CS
18.1.
If we know or suspect that you are in breach of these T&Cs, we reserve the right to immediately suspend your account until an investigation has determined whether you are in fact in breach.
18.2.
If it is determined that you are in breach of the T&Cs, we reserve the right to take any or all of the following actions:
1)
terminate your account;
2)
reclaim any winnings from your credit balance;
3)
take action to recover any losses suffered by SwitchPlayed;
4)
prohibit you from future use of the Service; and
5)
report you to any relevant authority.
19.ASSIGNMENT
You may not assign these T&Cs to any third party. We may transfer, assign or novate our rights and obligations at any time without notice to you.
20.SEVERABILITY
If any of these terms, conditions and provisions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
21.ENTIRE AGREEMENT
These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede any previous arrangement, understanding or agreement between us, relating to the provision of the Service.
22.OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
We have the right to revise and amend these T&Cs from time to time. Prior to any change, you shall be notified of a change either by way of email or notice on the site itself. Continued participation after such notice shall be taken as deemed acceptance by you of the changed terms.
23.THIRD PARTY RIGHTS
The Contracts (Rights of Third Parties) Act 1999 does not apply to this agreement.
24.LAW AND JURISDICTION
These T&Cs will be governed by the laws of England and any dispute or claim arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts of England and Wales.
